These Terms of Use (“Terms”) govern your use of wayfinderboots.com and the fitting, scanning, and recommendation services offered there (the “Services”), operated by Indoor Cat Boot Works, Inc. (“Wayfinder,” “we,” “us”). By creating an account or using the Services you agree to these Terms and to our Privacy Policy, which is incorporated by reference.
1. The Services
Wayfinder provides personalized ski boot and trail running shoe recommendations based on your quiz answers and, if you choose, measurements taken from a 3D scan of your feet. We link you to independent retailers to purchase; we do not sell footwear ourselves.
2. Eligibility
You must be at least 16 years old to create an account or use the Services. By using the Services you represent that you meet this requirement. If we learn a user is under 16, we will close the account and delete its data as described in the Privacy Policy.
3. Accounts
You are responsible for your account credentials and for activity under your account. Keep your password confidential and notify us at info@wayfinderboots.com if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms. You may delete your account at any time; the Privacy Policy describes what happens to your data.
4. Your Fit Data; License to Wayfinder
You retain all rights in the information you provide: your quiz answers and the fit measurements derived from your foot scan (“Fit Data”). You grant Wayfinder a limited, non-exclusive license to store and process your Fit Data solely to provide the Services: generating and saving your recommendations, sizing footwear, and improving fit accuracy, consistent with the consent you give and the Privacy Policy. This license ends when your Fit Data is deleted.
Foot scanning is provided by Volumental, an independent company, under its own terms and privacy policy presented at the time of scanning.
5. Recommendations Are Informational, Not Medical Advice
Our recommendations are informational suggestions based on fit modeling. They are not medical, podiatric, or health advice, and are not a substitute for professional care. If you have a medical condition affecting your feet, consult a qualified professional. Fit is inherently individual; we do not guarantee that any recommended product will fit or perform for you.
6. Retailer Links; Affiliate Disclosure
Product links lead to independent retailers. Your purchase is from the retailer under its terms; we are not a party to the transaction and are not responsible for retailer pricing, availability, shipping, or returns. Some links are affiliate links: Wayfinder may earn a commission on qualifying purchases, at no additional cost to you.
7. Intellectual Property
The Services, including all site content, software, recommendation logic, designs, and trademarks, are owned by Indoor Cat Boot Works, Inc. or its licensors. We grant you a limited, revocable, non-transferable license to use the Services for personal, non-commercial purposes. You may not copy, scrape, data-mine, republish, or create derivative works from the Services without our written permission.
8. Prohibited Conduct
You agree not to: use the Services unlawfully; access them with bots, scrapers, or other automated means; probe or breach security measures; interfere with the Services’ operation; misrepresent your identity; or attempt to access another user’s account or data. We may suspend access for violations.
9. Feedback
If you send us suggestions or feedback, we may use them without restriction or compensation.
10. Disclaimer of Warranties
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-interruption. Recommendation outputs depend on the information you provide and on modeling that cannot be perfect.
11. Limitation of Liability
To the fullest extent permitted by law, Indoor Cat Boot Works, Inc. will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including from reliance on any recommendation or from purchases made through retailer links, and our total liability for any claim will not exceed the greater of $100 or the amount you paid us for the Services in the 12 months before the claim (the Services are currently free). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify Indoor Cat Boot Works, Inc. against claims arising from your violation of these Terms or misuse of the Services.
13. Changes to These Terms
We may update these Terms. Non-material changes are effective on posting. Material changes take effect 30 days after we post them and notify existing users (by email or a prominent site notice), except where a change is needed immediately for legal or security reasons. We may ask you to accept updated Terms to continue using the Services; if you don’t agree, stop using the Services and, if you wish, delete your account.
14. Governing Law; Disputes
These Terms are governed by California law, without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction.
15. Miscellaneous
If any provision is unenforceable, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services. You may not assign these Terms; we may assign them in connection with a business transfer. Our failure to enforce a provision is not a waiver.
